Terms AND Conditions

1. AGREEMENT

This Terms of Service, Policies, and Conditions (the "Terms") contain the terms, policies, and conditions, including but not limited to our Website Terms and Conditions, Privacy Policy, Booking and Cancellation Policy, Regulars' Club Policy, Voucher and Multipass Policy, and Private Rental Policy, (collectively, the "Policies"). These policies collectively govern your use of our website, https://www.saunawelt.com (the "Website"), and/or our facility located at 18313A Egret Bay Blvd, Houston, Texas, 77058, United States (“Facility”).

The Website and the Facility are owned by Saunawelt, LLC ("Saunawelt", "us", "we" and "our")  

The Terms apply to all users of the website and/or of the Facility including, without limitation, users who are browsers, vendors, customers (“Customers”), merchants, and/ or contributors of content ("You" or "Your").

By visiting our Website and/or booking/purchasing from us, you engage in our “Services” and this constitutes your acceptance of and agreement to the Terms. If you make a booking for additional guests, you confirm that you are authorized to do so on their behalf, and that all guests included in the booking are deemed to have accepted and agreed to these Terms and all applicable Policies.

If you do not agree to be bound by the Terms, please exit the Website. Also, consult our Privacy Policy for a description of our data collection practices and privacy policies. 

We reserve all rights to alter the Terms at our discretion. We will post a notification on the Website in the event of any material change to the Terms. Such changes, whether in the form of modifications, additions, or deletions, shall be effective when specified in the relevant notification or, if the change is immaterial, immediately upon appearing on the Website.  Please check the Terms periodically for changes. Your continued use of the Website and/or the Services following our posting of any changes to these Terms means that you accept and agree to those changes.

You may not use our Website and/or Services for any illegal or unauthorized purpose, nor may you violate any laws in our and your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses, or any code of a destructive nature, to our Website.

A breach or violation of any of the Terms will result in the immediate termination of your Services.

Definitions in these Terms are set out at the end.

2. COMMUNICATION

We will communicate with Customers primarily via e-mail. It is your responsibility to ensure that the correct contact details are provided and that the nominated e-mail address is regularly checked for correspondence.

3. FACILITY RULES

(a) Sauna House Features & Operations

The features of the Facility include, but are not limited to, the following (collectively, the “Sauna House Features”): Sauna House Access, Special Events, Classes, Workshops, Retreats, and Private Rentals.

  • Bookings and Policies: All bookings for the Sauna House Features must be made in accordance with the separate Bookings & Cancellations Policy.

  • Facility Hours & Changes: The standard operating hours for the Facility (the “Access Hours”) will be made available on the Website. We reserve the right, for any reason and at any time without notice to you, to change, adjust, or cancel Sauna House Features, including altering Access Hours or temporarily closing the Facility for capacity considerations, private events, maintenance requirements, or any other reason determined appropriate in our sole discretion.

  • Limited Access: We may limit your access to the Facility and/or Sauna House Features based on the terms and restrictions attached to the specific Facility access you purchased; such terms will be provided to you at the time of purchase.

(b) Health and Safety Requirements

Your use of the Facility and Sauna House Features is entirely at your own risk. You acknowledge and agree that immersion in hot and cold environments can pose health risks.

  • Medical Screening & Clearance: Before using the Facility, you must confirm that you have been examined by a qualified medical practitioner within the past six (6) months and have been found to be in good physical health and physically able to bathe in hot and cold environments.

  • Contraindicated Conditions: Use of the Facility is not recommended and may be complicated or exacerbated by certain pre-existing medical conditions, including but not limited to: high fever, extreme hypertension, malignant tumors and cancerous conditions, liver/kidney/circulation disorders, conditions presenting a high risk of hemorrhaging, anemic conditions, congestive heart failure, recent stroke or heart attack, diabetes, and pregnancy.

  • Strictly Prohibited Entry (Acute Conditions): For the safety of all patrons and due to the high risk of contagion or acute personal harm, you are strictly prohibited from entering or using the Facility or any Sauna House Features if you currently have, or are recovering from, any of the following acute, infectious, or severe medical conditions:

    • Fever or Acute Viral Infection (e.g., flu or COVID-19).

    • Communicable skin disease, septic infections, or inflammatory/uncured skin diseases, including eczema.

    • Acute inflammation of internal organs, or acute or uncured tuberculosis.

    • Heart inflammation, phlebitis, or any condition within the first three (3) months after a stroke.

    • Severe or serious disorders of the central nervous system or circulatory system.

    • Diseases manifested by sudden attacks (e.g., epilepsy).

  • Your Responsibility to Stop: You must immediately stop your use of the Facility if you become injured or experience any feeling of dizziness, nausea, or severe discomfort. If the symptoms or injury are serious, you must immediately seek medical attention. You are prohibited from returning to the Facility after any serious injury or illness that required medical attention until you have obtained your doctor’s written permission.

  • Assumption of Risk: You express your voluntary participation and use of the Facility with full knowledge that there is a risk of personal injury, property loss, or death, particularly due to the physically strenuous nature of some features. Refer to Section 9 (Indemnity) and Section 10 (Limitation of Liability) for further details.

(c) Required Conduct and Hygiene

  • Mandatory Showering: You must shower with soap and water before using the Sauna House Features. This is mandatory for hygiene and safety, and to remove any oils, lotions, or fragrances that could damage wood surfaces.

  • Towel Usage: You are required to sit on a towel at all times when in the sauna. Your bare skin must never touch the wood surfaces.

  • Attire: The Facility is not a textile-free environment. Proper swimwear is required to utilize the Facility at all times, including the locker room and common areas. Private changing cabins are provided in the locker room.

  • Facility Cleanliness: You are responsible for leaving the Facility in good condition for other Customers. You must clean up after yourself and dispose of all waste (including items for recycling and compost) in the marked receptacles.

  • No Reservation of Space: You may not reserve furniture, lounge areas, or sauna benches with towels or personal belongings. Any items left unattended for an unreasonable period may be moved by our staff.

  • Property & Security: We are not liable for the security or loss of your property. We recommend that valuable items be left at home.

(d) Prohibited Items and Behavior

  • Zero-Tolerance Policy: We maintain a zero-tolerance policy for any inappropriate behavior, including but not limited to engaging in any lewd or sexual activity at the Facility. Any violation will result in immediate escort out, permanent banning from our premises, and no refund or credit issued.

  • Respectful and Inclusive Environment:

    • The Facility is an inclusive space. You must respect all people and all bodies in the Facility. Verbal or physical actions that make anyone feel uncomfortable are prohibited and constitute grounds for immediate removal and refusal of future entry.

    • A respectful and considerate environment is expected, including being mindful of your tone, volume, and topics of conversation. Management reserves the right to ask guests to leave the premises, with or without prior warnings, for rude, obnoxious, or disruptive behavior. No refund will be issued.

  • Prohibited Items: The following are strictly prohibited from the Facility.

    • Food or beverages other than those provided or sold by Saunawelt.

    • Nicotine products or smoking of any substance, including electronic cigarettes. Guests using such products will be asked to leave with no refund provided.

    • Illicit or illegal substances.

    • Alcohol, unless previously authorized by us in writing.

  • Intoxication: Customers under (or apparently under) the influence of alcohol or drugs will be refused entry to the Facility, in our sole discretion.

  • Technology Restriction: The use of technology in all forms (including cell phones, e-readers, and smartwatches) is not permitted while using the Facility. Devices must be left outside of the Facility or stored in muted mode in the provided locker. Any use of such devices beyond the reception area is considered a breach of privacy and constitutes grounds for immediate removal without refund. Any Customer violating this requirement may be subject to further legal action based on the nature of the violation.

(e) General Compliance and Liability

  • Staff Instructions: You must follow all instructions given to you by our staff, and you acknowledge that any failure to do so will be at your own risk and may cause injury.

  • Prohibited Actions: You must not:

    • Use the Facility or any Sauna House Feature other than for its intended purpose.

    • Obstruct or interfere with any of the entrances or common areas of the Facility.

    • Engage in any unsafe or dangerous behavior.

    • Damage any of the saunas, sauna equipment, furniture, or any other property in the Facility.

  • Damage Reimbursement: We reserve the right to seek reimbursement should a Customer's conduct intentionally or recklessly cause damage to our facilities or physically harm our personnel or other guests. A Customer's failure to provide necessary reimbursement may result in legal action to recover for such damages.

  • Communication: We will communicate with Customers primarily via e-mail. It is your responsibility to ensure that the correct contact details are provided and that the nominated e-mail address is regularly checked for correspondence.

4. ASSUMPTION OF RISK, WAIVER, AND RELEASE

YOU ACKNOWLEDGE THAT YOUR USE OF THE SAUNAWELT FACILITY, SAUNAS, COLD PLUNGE, AND RELAXATION AREAS IS ENTIRELY VOLUNTARY AND AT YOUR OWN RISK.

(a) Assumption of Risk

You understand and acknowledge that the use of a sauna and wellness facility involves inherent risks, including, but not limited to, the risk of: burns, heat exhaustion, dehydration, hyperthermia, hypothermia, high or low blood pressure, fainting, slips, falls, broken bones, and other injuries, as well as aggravation of pre-existing medical conditions. You represent that you are in good physical condition and have no medical condition that would prevent you from safely using the Facility. 

(b) Waiver of Liability

You, for yourself, your heirs, personal representatives, and assigns, voluntarily and forever waive, release, and discharge Saunawelt, LLC, and its owners, members, managers, employees, directors, affiliates, contractors, and agents (collectively, the “Released Parties”), from any and all claims, demands, causes of action, liabilities, and damages arising out of or related to the use of the Facility, whether caused by the negligence of the Released Parties or otherwise. 

(c) Health Screening

You agree to immediately discontinue use of the Facility if you feel dizzy, nauseous, or unwell, and to seek immediate medical attention. You will obtain your doctor’s permission before returning if you have experienced any such condition or injury.

5. ACCESSIBILITY

Saunawelt is committed to helping those with disabilities access the Website and/or the Facility. We strive to provide an excellent experience for all our Customers, including those with sight, hearing, and other disabilities. 

If you have any special requirements or needs, we recommend that you contact us by phone or email prior to your booking to discuss arrangements and/or requirements.  We will be happy to arrange a visit to assist with the familiarization of our Facility.  

While our Facility is designed in accordance with the Americans with Disabilities Act, we advise Customers with special accessibility/mobility requirements to visit the Facility with a friend or carer who can help them navigate the Sauna House Features.  Please share any information about difficulties, mobility limitations, or disabilities you may have prior to your arrival, so we can make the experience work for you.

Electric wheelchairs and mobility scooters are not allowed inside the Facility.  Please use a standard wheelchair. We cannot guarantee that electric wheelchairs or mobility scooters can be stored during your visit due to limited space and passageways/fire exits that must remain clear at all times.  Electric wheelchairs and mobility scooters can be parked outside the entrance under the responsibility of the owner.  

Staff are not available to push Customers around the Facility, nor are they ‘person manual handling’ trained.  We advise bringing a carer to assist. 

We are unable to accommodate service dogs or emotional support animals of any kind within the Facility for reasons of hygiene and allergies.  We recommend a friend or caregiver accompany you.  

6. LEGAL CAPACITY

By accessing or using the Website and/or the Facility, or by clicking to accept these Terms when this option is made available to you, you represent and warrant that you are at least the age of majority in your state of residence, are legally entitled to enter into the Terms, are legally able to enter into any and all purchase agreements with us and our partners, vendors, agents and service providers, and have the right, authority, and capacity to enter into and abide by the Terms. You acknowledge and agree that your ability to access and/or use certain Facility may require a minimum age that is higher than the applicable age of majority.  

By entering and/or using the Facility, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable Policies, as displayed on-site and on our Website.

You must be eighteen (18) years of age or over to use the Facility.

Entry into the Facility and the purchase of any Regulars Club Plan (“RCP”) is an acknowledgment by you that you are eighteen (18) years or over and accept the Terms and agree that you have entered into a binding legal contract with us in relation to the Terms. Note that the full terms governing the Regulars Club Plan are set out in the Regulars' Club Policy, which is incorporated by reference into these Terms

If you are between 14 years old and under the age of 18 years (a “Minor”), you must immediately cease accessing and using the Facility unless you have permission from a parent or guardian.  If you are found to be a Minor without this permission, we are entitled, at our absolute discretion, to cancel or terminate your Session or RCP and refuse your entry into the Facility.  You will not be entitled to a refund.  

Minors must always be accompanied by a parent or guardian.  The parent or guardian is required to pay for the use of the Facility and must be with the Minor at all times. The parent or guardian is responsible for the Minor in their care at all times.  

If you are a parent or guardian permitting a Minor to access and use the Facility, you agree to exercise supervision over the Minor's use of the Website and Facility; assume all risks associated with the use of the Website and Facility as outlined in the assume all risks associated with the use of the Website and Facility as outlined in the Terms, specifically Section 7 (Indemnity) and Section 8 (Limitation of Liability); ensure that all content and information that the Minor may encounter on the Website is suitable and appropriate for the Minor; assume all liabilities resulting from the Minor's use of the Website and the Facility; ensure the accuracy and correctness of all information submitted by the Minor; provide the consents required by these Terms on behalf of the Minor; and recognize we reserve the right to restrict access and refuse entry to Minors for the Facility.

7. FORCE MAJEURE

Saunawelt will not be responsible for any delay or failure to perform its obligations under the Terms or otherwise which arises out of or is due to unforeseeable events or events independent of the intention of the parties such as “Force Majeure” events (including, but not limited to, war, terrorism, inclement weather, lack of energy, pandemics, interventions, and prohibitions of official authorities, and supplier delays). 

Such events may prevent us from providing you with access to the Facility in whole or in part.  In such cases, both parties agree that we will not be liable for any delay or failure in performing our obligations while such events persist.

If the delay or failure referred to in this Force Majeure clause continues for two calendar months or more, then you may terminate your RCP (governed by the Regulars' Club Policy) by giving written notice to us.

8. OWNERSHIP OF INTELLECTUAL PROPERTY, COPYRIGHTS, AND LOGOS

The Services and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of Saunawelt. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.


You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the Website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the Website.

9. INDEMNITY

You agree to indemnify, defend and hold harmless Saunawelt and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees (collectively, the “Indemnified”), harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of the Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. This indemnity survives termination of the Term.

10. LIMITATION OF LIABILITY

Saunawelt is not liable for incidental, indirect, consequential, special, or punitive damages of any kind that you or others may suffer, including but not limited to damages for lost profits or revenues, physical harm, loss or damage to personal property arising from or related to Saunawelt’s performance, even if Saunawelt should have known of the potential. 

To the maximum extent permitted by law, we exclude all conditions, guarantees or warranties expressed or implied by law; and any liability to you or to any third person however arising (and whether arising under statute, negligence or otherwise) for any personal injury or death to you or any third person, or for any special, direct, indirect or consequential loss or damage (including, but not limited to, loss of income or revenue, loss or interruption of business, loss of profits, revenue or contracts, loss of anticipated savings, loss of data, loss of use, loss of privacy or loss of goodwill), arising out of, or in connection with, any person’s access and/or use of the Facility, Sauna House Features, Saunawelt Products, Materials or Website.

Without limiting the generality of the foregoing, you agree that in no event shall our maximum aggregate liability exceed the total amounts you have paid to us in the past 6 months.  

You acknowledge and agree that the limitations of liability contained in this clause are a fair and reasonable allocation of the commercial risk between the parties.

To the maximum extent permitted by applicable law, Saunawelt assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein. 

11. PRIVACY POLICY

Your personal information and privacy are important to us. Our Privacy Policy governs the processing of all personal data collected from you in connection with your use of the Website and/or the Services. The Privacy Policy and its Terms and provisions are hereby incorporated and made a part of these Terms by this reference. Note that this Privacy Policy does not cover data collected by third-party processors, including TRYBE (our scheduling and subscription provider) and Wix (our online retail provider), whose collection and use of information are governed by their respective policies. You must agree to the Privacy Policy in order to use the Website and/or the Services.

12. ERRORS ON WEBSITE

We are not responsible if information made available on this Website is not accurate, complete, or current. The material on this Website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this Website is at your own risk.

This Website may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this Website at any time, but we have no obligation to update any information on our Website. You agree that it is your responsibility to monitor changes to our Website.

13. USE OF PRODUCTS

All the products purchased from Saunawelt should be used in accordance with the manufacturer’s instructions, precautions, and guidelines.  Saunawelt cannot assume responsibility for any damage, loss, or injury arising from their use.

14. RETURN AND REFUNDS POLICY

Retail Returns (In-Store Purchases).
Returns for items purchased in person at the Facility are accepted within fourteen (14) days of the date of purchase. All returned items must be in brand new, unused, unopened, and re-saleable condition. A valid, itemized proof of purchase is required. All returns are subject to verification and approval by Saunawelt management, in its sole discretion. Upon approval, a refund will be issued to the original method of payment, subject to the exclusions set out in this Policy.

Online Returns.
Returns for items purchased through the Website are accepted within fourteen (14) days of the date of purchase. All items must be in brand new, unused, unopened, and re-saleable condition. Customers are responsible for all return shipping costs and must arrange their own return shipping; Saunawelt does not provide return shipping labels for online returns unless the item is confirmed to be faulty or damaged. To request a return, you must reply to your order confirmation email. All online returns are subject to assessment and approval by Saunawelt management, in its sole discretion. Refunds for approved online returns will be issued after the item is received and inspected and will be reduced by any applicable return shipping costs.

Non-Returnable and Excluded Items.

Certain items are strictly non-returnable and non-refundable. All swimwear is final sale and cannot be returned or exchanged under any circumstances for hygiene and safety reasons. Gift cards, Multipasses, all food and beverage purchases, and all sale or discounted items are also non-returnable. Items that have been opened, sampled, used, damaged, or are otherwise not in their original condition may not qualify for a refund. Items marked “Final Sale” at the time of purchase are not eligible for return. Saunawelt management retains full discretion to determine whether an item meets the return criteria described in this Policy.

Faulty or Damaged Items.
If an item arrives damaged, faulty, or incorrect, you must notify us immediately at hello@saunawelt.com and provide a description of the issue, photographic evidence (if applicable), and proof of purchase. If we verify that the item is faulty, damaged, or incorrect, we will provide either a replacement or a refund in accordance with applicable Texas law, and a return shipping label will be supplied when necessary.

Refund Method.

Refunds for eligible returns will be issued only to the original method of payment. Saunawelt does not issue cash refunds for card purchases. If the original payment method is unavailable, or if a refund cannot be processed to that method, Saunawelt may issue store credit as an alternative resolution at management discretion.

15. UPDATING OF TERMS

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

16. SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

17. ENTIRE AGREEMENT

These Terms and any Policies or operating rules posted by us on the Website or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

18. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law principles. You agree that any legal action or proceeding between Saunawelt and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Harris County, Texas.

19. DEFINITIONS

In these Terms:

  • “Access Hours” means days and times in which the Facility will be open and available for Customers to make Bookings, including times for various Sauna House Features.

  • “Booking” is a legally binding contract where a Customer agrees to pay a specified amount in exchange for a period of exclusive, time-restricted access to the Sauna Facility.

  • “Customer” means any individual or entity that has entered into a legally binding agreement with Saunawelt for access to the Facility. This includes both: 

    • An individual who purchases single-session or other limited-term access through a financial transaction.

    • An individual who is a subscriber of the Regulars Club Plan ("RCP") and pays a recurring fee for ongoing access to the Facility. 

  • “Facility” means the sauna house located at 18313A Egret Bay Blvd., Houston, TX,77058;

  • “Facility Access” means access to the communally accessible spaces and facilities at the Facility;

  • “Intellectual Property” means all present and future intellectual or industrial property rights (whether or not registered) throughout the world, including, without limitation, in respect of patents, copyright, moral rights, trade names, trademarks, logos, systems, circuit layout, designs, software, plant breeder’s rights, domain names, trade secrets and confidential information;

  • “Material” means any information, data, source codes, drawings, content, text or images in any form (whether visible or not), audio recordings, video recordings, lists, sound, video, links, layout, look and feel, control features and interfaces contained on the Website, or otherwise displayed, uploaded or published on, or via, the Website;

  • “Policies” means the Privacy Policy, Booking and Cancellation Policy, Regulars' Club Policy, Voucher and Multipass Policy, Private Rental Policy, and Website Terms and Conditions, all of which are explicitly referenced and incorporated herein.

  • “Privacy Policy” means our Privacy Policy available at (enter website link);

  • “RCP” mean a subscription-based program governed by the Regulars' Club Policy (LINK) and constitutes a legally binding agreement in which subscribers pay a recurring fee in exchange for specific, ongoing access to goods, services, and benefits as detailed in the Policy. 

  • “Saunawelt”, “us”, “we”, “our” means Saunawelt, LLC, EIN 99-3086217;

  • “Saunawelt Product” means any Saunawelt item offered for sale through the Website, including, but not limited to, Facility Access, Multipasses, Vouchers, and retail merchandise.

  • “Sauna House Features” include, but are not limited to, the following:

    • Sauna House Access;

    • Special Events;

    • Classes; 

    • Workshops; 

    • Retreats; and

    • Private Rentals.

  • “Session” means a period of time in which a Customer has made a Booking for a Facility Access;  

  • “Start Date” means the date on which an RCP will commence, as listed in the relevant Regulars’ Club Plan.

  • “Terms” means these Terms & Conditions together with our Privacy Policy

  • “Voucher” means a voucher that can be used to make certain Bookings in accordance with the Voucher clause;

  • “Website” means the website located at http://www.saunawelt.com/; and

  • “You" or "Your" means the person or entity accessing, using the Facility or Website and includes, when applicable, Customers.
